Compliance, consent and controlled campaign delivery

We help you launch email and SMS campaigns on B2C opt-in audiences, without transferring contact files, with integrated management of unsubscribes, opt-outs and data-related requests.

B2C opt-in audiences

Proprietary audiences, qualified and maintained by us

Our campaigns are delivered to individual consumers who have consented to receive marketing communications by electronic means, specifically by email and SMS. Our audiences are exclusively B2C and consist of proprietary opt-in databases.

We do not build client audiences from scraped files, one-off resold lists or third-party databases delivered for an isolated campaign.

Audience B2C only
Origin Proprietary opt-in databases
Management Ongoing qualification and maintenance
No file delivery

You choose the target. We operate the delivery.

With DMS Europe, you define your target, country, channel and volume. However, contact files are not delivered, exported or transferred as part of our standard campaigns.

The data remains hosted and operated by DMS Europe. We route the campaign ourselves, which allows us to retain technical, legal and operational control over delivery.

Unsubscribes, SMS STOP requests and exclusions are built into the system

Email unsubscribe

Each email campaign includes an unsubscribe mechanism.

SMS STOP

Each SMS campaign includes the applicable opt-out methods, including SMS STOP where required.

Exclusion lists

Opt-out, erasure and unsubscribe requests are taken into account in our internal exclusions.

SMS routing

Professional, secure SMS routes operated within a controlled framework

Routing quality is a key factor in compliance, deliverability and recipient trust.

For our SMS campaigns, we prioritise professional routing through direct operator routes or equivalent secure routes, designed for legitimate and controlled marketing use cases.

We do not use grey routes, opaque circuits or solutions intended to bypass local delivery rules. This approach helps preserve delivery quality, campaign reputation and the proper handling of opt-out mechanisms.

Depending on the country of delivery, specific requirements may apply to sender identification, message format, opt-out wording or routing methods. These elements may be reviewed before delivery.

Professional routes

Routes suited to legitimate marketing campaigns, within a controlled delivery framework.

No grey or opaque routing

We avoid circuits intended to bypass local rules or hide the actual delivery path.

SMS STOP and exclusions taken into account

Opt-out mechanisms are integrated into our post-campaign management process.

Quality control

Pre-delivery checks based on context and risk level

A campaign may be approved automatically or manually before it is routed.

What we may check

  • Advertiser identity
  • Message content
  • Offer consistency
  • Destination URL and landing page
  • Compliance with the rules applicable to electronic marketing

How these checks may be performed

These checks may be performed automatically, by our algorithms, by our artificial intelligence systems or manually by our teams, depending on the country, channel, volume or risk level identified.

We may refuse, suspend or request changes to a campaign if its content, destination, sector or commercial claim presents a risk of non-compliance, confusion or damage to the reputation of our audiences.

European framework and United Kingdom

An approach adapted to the markets we cover

For the United Kingdom, we take into account the UK GDPR, PECR and the Data Protection Act 2018. For campaigns delivered in the European Union, our approach is designed around GDPR requirements, as well as the rules applicable to electronic marketing.

United Kingdom UK GDPR, PECR and Data Protection Act 2018
France GDPR and rules applicable to electronic marketing
Spain GDPR and operational adaptation depending on the channel
Italy GDPR and local electronic marketing rules

Some local requirements may vary depending on the country, channel, business sector, advertiser identity or nature of the message. Where necessary, we may adapt the operational validation of a campaign before delivery.

Supervisory authorities

Practices aligned with the recommendations of local authorities

We follow the recommendations published by the competent supervisory authorities in the main markets we cover, in order to adapt our practices to local requirements for data, consent and electronic marketing.

United Kingdom ICO

Information Commissioner’s Office

France CNIL

Commission nationale de l’informatique et des libertés

Spain AEPD

Agencia Española de Protección de Datos

Italy Garante

Garante per la protezione dei dati personali

These recommendations may evolve depending on the country, channel and market practices. We may therefore adapt our checks, validation rules or delivery methods when the local context requires it.

Advertiser responsibilities

We frame the delivery, but the advertiser remains responsible for its offer

We route campaigns on our opt-in audiences within a controlled framework. However, the advertiser remains responsible for its offer, commercial claims, landing page, legal notices, conversion path and compliance with the rules specific to its sector.

Some activities or commercial claims may require additional checks, or may be refused if they present a legal, regulatory, reputational or operational risk.
